By accessing or using the De Leville Digital Soul platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
These Terms apply to all visitors, soul owners, and brand partners. De Leville Atelier ("De Leville", "we", "us") reserves the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
A Digital Soul is a non-fungible token (NFT) on the Polygon blockchain, permanently bonded to a physical De Leville piece. Each Digital Soul:
Claiming a Digital Soul creates a binding link between your email address and the NFT. You are responsible for maintaining access to that email address.
When you own a Digital Soul NFT, you own the token on the Polygon blockchain. This ownership:
We do not guarantee the value of Digital Soul NFTs. NFT markets are volatile. Secondary market activity is not endorsed or controlled by De Leville.
Loyalty points and tier status are governed by the following rules:
Loyalty events and provenance records written to the Polygon blockchain are permanent and immutable. By using check-in and experience logging features, you consent to your loyalty activity being recorded on a public blockchain. This data is pseudonymous (linked to a token ID, not your name).
De Leville cannot delete, modify, or reverse on-chain records. Exercise care before confirming any blockchain transaction.

Violation of these rules may result in suspension of loyalty benefits, forfeiture of points, and legal action.
The Platform may offer a Living Legacy feature that creates AI-based digital representations. By creating a Living Legacy profile:
Enterprise use of the Digital Soul platform is governed by a separate Data Processing Agreement (DPA) and commercial contract. If you represent a brand or enterprise, contact hello@deleville.co to obtain the appropriate agreements before onboarding.
The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, accuracy of blockchain data displays, or continuity of third-party services (Crossmint, Supabase, Resend, Polygon network).
To the fullest extent permitted by law, De Leville's total liability for any claim arising from your use of the Platform shall not exceed €100.
We are not liable for: loss of NFT access due to wallet or email loss, blockchain network failures, smart contract bugs outside our control, or market value fluctuations of NFTs.
These Terms are governed by the laws of Belgium. Any disputes shall be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium, unless mandatory consumer protection law in your jurisdiction provides otherwise.
